Husband Sues Hospital After Seeing what They Did his Wife
A husband in Phoenix filed a lawsuit against a local hospital this week, claiming doctors performed an unauthorized hysterectomy on his wife while she was under anesthesia for what was supposed to be a routine gallbladder removal. The couple had been trying to start a family, and the man only learned of the procedure weeks later after spotting the details in her medical discharge papers.
According to the complaint, his wife went in for laparoscopic surgery in early September and woke up with additional incisions that no one explained at the time. Hospital staff reportedly told her the extra work was necessary due to complications, but the husband says he was never consulted and no consent forms for the removal of her uterus appear in the records he obtained.
The suit alleges medical battery and lack of informed consent, seeking damages for emotional distress and the permanent loss of fertility. Attorneys for the family argue the hospital overstepped during a moment when the patient could not advocate for herself.
Hospital representatives have not commented publicly on the case, though internal reviews of surgical protocols are reportedly underway. Similar lawsuits over unapproved procedures have surfaced in other states in recent years, often hinging on whether doctors believed an emergency justified acting without explicit approval.
The husband told reporters he felt betrayed by the system he trusted with his wife’s care. The case is scheduled for preliminary hearings next month.
